These Terms of Service govern the public HealthProtect website, its domain-verification register, and its hosted verification badges and embed code (together, the “Service”). The Service is operated by Health Protect LLC, doing business as HealthProtect (“we,” “us,” or “our”).
Please read these Terms before using the Service. By using the Service after being given notice of these Terms, you agree to them to the extent permitted by applicable law. If you do not agree, do not use the Service. If you act for an organization, you must have authority to bind it.
1. What these Terms cover
These Terms cover public access to the register and use of its hosted badges. The public register does not require a visitor account or accept payment for a lookup.
Certification applications, subscriptions, audits, identity checks, commercial integrations, fees, renewals, and appeals may be governed by a separate agreement. These Terms do not enroll an operator in a certification program or promise certification. A separate signed agreement controls a conflict concerning the services it covers; it does not remove anyone’s mandatory legal rights.
Our Privacy Policy explains how we handle personal information. Accepting these Terms is not consent to data processing for which the law requires a separate choice or consent.
2. Understanding a register result
A HealthProtect result reports the certification status recorded for the domain checked when the lookup is processed. Records and statuses can change. A result concerns that domain and the identified operator; it does not automatically cover every related domain, affiliate, practitioner, pharmacy, product, or transaction.
An active result means the register currently records an active certification. A lapsed result means a recorded certification is no longer active. An unlisted result means the lookup did not return an active or lapsed listing; it is not a finding that a business is unlawful, fraudulent, or unsafe. An unavailable result or an absent badge may reflect a technical problem or a request limit and is not a certification determination.
A current date displayed on a result or badge identifies the date of the register status check. It does not mean every aspect of the operator’s business was independently audited on that date. A fresh database lookup is not, by itself, a fresh inspection of clinical care, business ownership, licensing, or website content.
Screenshots, copied images, and previously downloaded results may be out of date. Follow the badge to the register, check the domain and operator, and perform any additional checks appropriate to your decision. You can report a suspected error using the contact information below; we may request supporting information before correcting a record.
3. Information, not healthcare or government approval
HealthProtect does not provide medical diagnosis, treatment, prescriptions, or emergency services through this Service. Its content is general information, not individualized medical, legal, regulatory, or financial advice. Use a qualified professional for advice about your circumstances.
A listing or badge is not government approval, a professional license, a guarantee of legal compliance, a recommendation of a treatment, or a guarantee of safety, efficacy, or quality. It does not guarantee acceptance by an advertising network, payment processor, insurer, or other third party. A provider remains responsible for its own care, products, statements, licenses, and legal obligations.
Do not delay medical care because of information in the register. For an emergency, contact your local emergency services.
4. Permitted use and misuse
You may browse the Service, make reasonable domain lookups, share links to register entries, and accurately quote limited results with attribution and the date checked, subject to these Terms and rights provided by law. Accessibility tools and ordinary search-engine indexing of pages allowed by our published crawling instructions are permitted.
You must not:
- Misrepresent a result, fabricate a certification, impersonate another person or business, or imply an endorsement that the register does not provide.
- Bypass request limits, security controls, or access restrictions; interfere with the Service; introduce malicious code; or attempt unauthorized access to systems or nonpublic records.
- Conduct bulk enumeration, scraping, or automated extraction of the register without written permission. Our official badge’s ordinary automated requests are permitted.
- Resell the register, build a competing database from systematic extraction, or redistribute substantial portions of its content without permission, except where applicable law permits it.
- Submit patient records, account passwords, identification documents, or other unnecessary sensitive information in a domain field or a routine support message.
- Use the Service unlawfully, infringe another person’s rights, or evade a third party’s compliance requirements using misleading certification claims.
5. Badge and embed permissions
Subject to these Terms, we grant a limited, nonexclusive, revocable permission to use the official embed code to display the live badge returned by the Service for a specified domain. You must be authorized to add the embed to the site where it appears. This permission does not grant certification or ownership of our marks.
Keep the badge’s identifying information and link to the register intact. Do not alter the artwork, obscure its subject, redirect its link, present a static copy as live verification, force a badge to remain visible when the Service returns none, or use another operator’s status to imply that your own business is certified. Placement on a website does not establish that the website itself is certified: the linked register entry identifies the domain being checked.
Use the current official embed and remove misleading or unauthorized displays promptly. We may disable or withdraw badge permission for misuse, a change in status, a security concern, or the end of the Service. You must stop displaying a badge when its permission ends. A separate certification agreement may impose additional obligations.
If you embed a badge, disclose its third-party requests in your own privacy information and obtain any consent or other authorization required before loading it. The badge sends technical request information to us even when a visitor does not click it. Do not put patient identifiers, medical information, or secret tokens in the domain or embed configuration.
6. Content and intellectual property
We and our licensors retain our rights in the Service’s software, design, original content, names, and marks. Operators retain rights in their own names and marks. Except for the permissions above, applicable statutory rights, or separate written permission, these Terms do not license either party’s intellectual property. We do not claim ownership of facts merely because they appear in the register.
If you send a correction or other material, you must have the right to provide it. You permit us to use it as reasonably necessary to investigate, respond, and maintain accurate records, subject to our Privacy Policy. Sending material does not guarantee a particular certification outcome.
7. Third-party services
Linked operators and other third-party websites have their own terms and privacy practices. Unless a separate agreement expressly provides otherwise, we are not a party to your purchase, treatment, prescription, subscription, or other dealings with an operator. Direct questions about that operator’s services, refunds, and medical care to it. A listing does not make an operator our agent.
8. Availability, changes, and suspension
We may correct records, maintain or change the Service, apply request limits, or suspend access reasonably necessary to address misuse, security, legal obligations, or operational problems. We may discontinue the Service. We will provide notice where required by law or a separate agreement.
We do not promise uninterrupted availability, a particular response time, or that every error or change in an operator’s circumstances will be detected immediately. You may stop using the Service at any time. Provisions that by their nature should continue, including ownership, limits on liability, and dispute terms, continue after use ends, subject to applicable law.
9. Warranties and limits of the Service
To the extent permitted by applicable law, the Service is provided as available, without a contractual promise that it will be error-free, complete, continuously available, or suitable for every purpose. We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement to the extent the law permits those disclaimers.
These Terms do not exclude a warranty, consumer guarantee, duty, or remedy that cannot lawfully be excluded. They do not excuse misleading statements or reduce duties that applicable law independently imposes on us.
10. Liability
To the extent permitted by law, neither party is liable to the other under these Terms for indirect or consequential losses, including lost profits, revenue, or business opportunities arising from use of, or inability to use, the free public Service.
No exclusion or limitation applies to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law does not allow to be excluded or limited. Mandatory consumer protections and statutory privacy remedies remain available.
11. Third-party claims caused by business misuse
If you use the Service for a business, that business will reimburse us for reasonable losses and costs, including reasonable legal fees, arising from a third party’s claim caused by its fraudulent or materially misleading badge use, unlawful use of the Service, or infringement of that third party’s rights. This obligation does not cover a claim to the extent caused by our own misconduct or breach of law and does not apply to personal or household users.
We will give reasonably prompt notice of a covered claim and reasonable cooperation, and take reasonable steps to limit losses. You may control the defense with competent counsel, but may not settle a claim in a way that admits fault by us or imposes nonmonetary obligations on us without our written consent, not to be unreasonably withheld.
12. Resolving concerns and disputes
You may contact us at certification@healthprotect.ai to try to resolve a concern. Informal contact is not a condition of exercising a legal right, does not prevent urgent relief or a regulatory complaint, and does not extend a legal filing deadline.
Applicable law determines the governing law and courts with jurisdiction over a dispute. Nothing in these Terms requires arbitration, waives a right to participate in a class action, or removes mandatory consumer protections or statutory privacy remedies.
13. Changes and general provisions
We will publish revised Terms with a new effective date and provide additional notice of material changes where required. Changes operate prospectively. Where law requires express agreement, we will obtain it rather than relying on continued use alone.
If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. A failure to enforce a provision once is not a waiver. These Terms and any applicable separate agreement are the agreement for their respective subject matter; they do not exclude liability for fraud or displace mandatory precontractual information or consumer rights.
